Virtual Mediation

Elsberry Mediation has implemented Virtual Mediation.

All forms of mediation, virtual and otherwise, demand confidentiality, security, and privacy.

 

Our office is currently using ZOOM Video Conferencing for its video platform.  Zoom is user friendly and allows joint and private conferences.  It is not necessary for the attendee to have a Zoom account.

With this process, we are able to offer face-to-face, securely connected video conferencing for any mediation session. We are able to caucus during mediation, with each party –  and their attorney  if they have one –  working in their own virtual “break-out” room, where only they can hear and see each other. Elise will move between the two virtual rooms. It is not necessary for the Virtual Mediation participants to be at their attorney’s office.

Independent Location

Each participant can be at an independent location or with their respective attorney. (Additional professionals, such as forensic accountants, parent coordinators or Guardian ad Litems can also appear in the virtual rooms from separate locations.)

Minimal Equipment

The participants will need nothing more than a phone, tablet, laptop or computer, equipped with a camera, microphone and speaker. We will send a link prior to the mediation by email for the participants to join the meeting.

Private Waiting Room

Zoom mediations begin with a “waiting room”. We suggest logging in 5 to 10 minutes before the start time. The mediation will begin with a “joint session” and all participants. The mediator shall act as the “host” and separate the participants in their own “break out” or caucus rooms. These are private and confidential.

Remotely Finalize Documents

To make it easy for all parties, Virtual Mediation participants are able to sign finalized agreements remotely through DocuSign. Participants do not need a DocuSign account.

*** All Parties will need a high-speed internet connection and a private, secure quiet space without distractions or interruptions.

 

*** Videoconference mediations must be kept private and confidential. No recording of any type and only the parties and their attorneys may attend and/or listen.
